NEW YORK, Sept 6 (Reuters) - Austrian bank Bawag, which is paying $675 million over its role in Refco Inc.'s (RFXCQ.PK: Quote, Profile, Research) collapse, said a creditor on Wednesday withdrew a lawsuit over the settlement, clearing the way for other creditors to make up some of their losses.
Hedge fund VR Global Partners LP had complained in U.S. district court in Manhattan that the settlement was unfair because it forced creditors to give up their individual claims against the bank, one of Austria's largest.
Bawag avoided possible criminal prosecution when it agreed in June to pay the $675 million to settle charges it helped Refco, a commodities and futures brokerage, commit fraud.
Unsecured creditors were to divide $506 million of this amount. VR Global was the only entity that appealed U.S. Bankruptcy Judge Robert Drain's approval of the settlement June 30, Bawag said.
"I am pleased that our efforts to reach a comprehensive settlement have come to a successful conclusion, and that the approval of the court (is) now final," Bawag Chief Executive Ewald Nowotny said in a statement.
VR Global lawyer Fred Hodara did not immediately return a call seeking comment.
Bawag's owner, Austrian trade union federation OeGB, is trying to sell the bank. Investment bank Morgan Stanley has invited tentative bids through Friday.
Refco filed for Chapter 11 protection from creditors on Oct. 17, two months after its initial public offering, and a week after revealing that former chief executive Phillip Bennett hid $430 million in debt. Continued...
